1. Introduction
The website is operated by Global Digital Média SA and/or its affiliates (the "Company"), which provide a social network allowing members, after creating an account, to interact with one another (the "Services"). The Services are intended for entertainment (media): passive browsing of online publications and profiles. They are not advice or matchmaking-agency services, and the Company does not organise meetings between Members. Use is strictly personal and private, and reserved for registered Members. The Company may offer features letting Members interact, including by "match" and messaging, with (i) other Members (real people) and/or (ii) AI-based conversational profiles ("AI Profiles"). AI Profiles are automated digital profiles for entertainment; they are not real people or Members and are explicitly labelled as such.
2. Requirements
To use the Services a Member must: be of legal age (18 or older) at registration; have legal capacity; own suitable computer equipment; and have a valid email address.
3. Definitions
"Subscription": a paid plan giving access to the Services for a limited period. "Member": an individual acting outside any professional activity who has completed registration. "Subscriber": a Member who has taken out a Subscription. "Account": the Member's reserved area. "Services": Basic Services and Additional Services. "AI Profile" / "AI Content": profiles and content created or assisted by artificial intelligence.
4. Purpose and scope
These Terms govern use and sale of the Services between the Company and any Member. They are accepted by ticking the dedicated box before creating an Account and/or subscribing. The version in force on the date of account creation or subscription applies.
5. Enforceability
These Terms are enforceable from the Member's acceptance. The Company may amend them and will make reasonable efforts to inform Members. Archived versions are available on request at [email protected].
6. Registration and account
To become a Member, the user completes the online form, reads and accepts the Terms, and receives a confirmation email. A Google sign-up option is available and shares your Google name, email and profile photo. Once registered, the profile is shown as "pending" during a verification period. With the Member's express consent, the profile may be made available on partner websites matching their search. The Member guarantees the data provided is accurate and agrees to keep it updated. The Company does not have the means to verify the identity of users.
6.3 AI Profiles
The Company may make AI Profiles available within browsing, suggestions, matching and/or messaging. The Member acknowledges that an AI Profile is not a real person or Member, that exchanges are for entertainment and user experience, that the Company does not guarantee the accuracy of AI content, and that AI Profiles may be changed, suspended, limited or removed at any time without compensation.
7. Subscription and payment
Subscriptions to Basic and Additional Services are generally paid, at the rates in force at subscription. Prices are shown in the Member's local currency and payable upfront by bank card or transfer. A free, limited access to Basic Services is offered to discover the features (it does not allow meeting other Members). Women members seeking to be connected with a man member receive free, full access to Basic Services (Additional Services remain paid). Card payment grants immediate access. For 3- and 6-month Subscriptions, payment is spread monthly from the second renewal. Temporary promotional offers may be proposed.
Satisfied or refunded: the Member may request a refund of the initial Subscription within fifteen (15) days, provided they: connected on at least three (3) different days, sent at least twenty (20) messages, have a validated (non-AI) profile photo, and a validated description.
Boosts: paid features to highlight your profile. They are activated immediately, considered consumed at once, and are non-refundable and non-exchangeable (except where the law provides otherwise). Using a Boost means the service starts on activation and you expressly waive your right of withdrawal. No specific number of views or interactions is guaranteed.
Costs: all hardware, software and internet access costs are borne by the Member.
8. Right of withdrawal
The Member has fourteen (14) calendar days from the sale to withdraw, without reason and at no cost, using the withdrawal form (available online) by email to [email protected] or by post to: Global Digital Média SA / Customer Service, Case postale 3230, 1211 Genève 3, Switzerland. Refund is made within fourteen (14) days. Exception: you cannot withdraw if delivery began at your request, which means you acknowledge losing your right of withdrawal.
9. Company obligations
The Company makes reasonable efforts to provide quality Services, maintenance and updates, and may temporarily close access for maintenance. It is not liable for the Member's equipment or internet access. Moderation: the Company has no general obligation to monitor content but acts on reported illegal or non-compliant content and may remove it; it fights fake profiles and may use automated tools (including for AI Profiles) to filter or block content. Security: reasonable efforts, no absolute guarantee. Protection of minors: the service is strictly for people aged 18+. Zero tolerance for any content involving minors (including CSAE). Any violation leads to immediate permanent suspension, blocking of associated content, and reporting to the authorities where required.
10. Member obligations
Provide accurate profile data; do not share your Account or give access to a minor; do not impersonate anyone. Photos must show the Member only, contain no text, no unrelated-only images, and be decent (no nude, suggestive or sexual content, no minors). Do not put phone, postal or email contact details (or Skype, etc.) on your profile or in messages; do not let yourself be filmed; do not send money to other Members. Use the Services lawfully and fairly. Prohibited uses include commercial/advertising use, hate or violence, scams, phishing, spam, malware, and links to unlawful sites. AI Profile interactions: no clearly illegal, violent or degrading requests, no content involving minors (real or simulated), no illegal pornographic content or paid sexual services, no attempts to bypass moderation, and no requests for personal data or social engineering.
11. Technical support
Customer service is available via the online "help" menu.
12. Intellectual property
Site content, trademarks, images, texts, and AI Profiles are the exclusive property of the Company and are protected. No rights are transferred to Members; use is private only. If a Member uploads no photo, an AI-generated image based on their declared preferences may be assigned to the profile, and by accepting these Terms the Member consents to its use. The Member grants the Company a worldwide licence to use the content they upload, for as long as it is online.
13. Liability and warranty
The Company is bound by an obligation of means. As a technical platform, it cannot guarantee that exchanges lead to actual meetings, nor that profile information matches reality, and is not liable for Members' behaviour. AI content is generated automatically and may contain errors; the Company is not liable for consequences of reliance on AI content, which is for entertainment. Partner websites accessible through links are not the Company's responsibility.
14. Reporting illegal content
Illegal or non-compliant content can be reported via the "abuse" link on each profile or by email to [email protected] (or by post to the Company), including the required details. Knowingly false reports are punishable by law.
15. Personal data
The data controller is the Company. Data collected: email (mandatory), date of birth, gender, sexual orientation, and photos (five photos auto-imported by default, which the Member may replace). Data is for internal use; bank data is shared with payment providers; with express consent, data may be shared with commercial partners to ease registration to additional services. Retention is limited to the purpose and at most two (2) years from the last visit. Data may be transferred to the following partners: DNX Network Sàrl, X CASH, Wellhello, Proximeety, Flirt Revenue and Salamandra Web SL (authorisation can be revoked in account settings). The Member has rights of access, rectification, erasure, restriction, objection, withdrawal of consent, portability and post-mortem directives, exercised by post to Global Digital Média SA, Case postale 3230, 1211 Genève 3, Switzerland (with proof of identity); the Company responds within two (2) months. A complaint may be lodged with a data protection authority. Interaction data (including messaging and AI Profiles) may be processed for service delivery, security, fraud prevention, moderation and improvement, including automated analysis.
16. Traceability
The Company keeps the Member's connection history and uses cookies in line with applicable law. Data identifying authors of defamatory or insulting content is kept for one (1) year from first publication.
17. Unsubscribe and termination
An Account may be deactivated after prolonged inactivity, with data deleted after two (2) years from the last login. The Member may delete their Account at any time via settings; no refund is given for the remaining Subscription period; a Subscriber must first cancel billing before deleting the Account. Card Subscriptions renew automatically unless cancelled (between 2 days after purchase and at least 2 days before renewal). The one-week trial is a two-week Subscription with a reduced rate for the first 7 days, renewing automatically for 14 days unless cancelled. The monthly Subscription renews each month. Terminating a Subscription incurs administrative and management fees of €19.74. Suspension or termination for fault applies in case of breach.
18. Force majeure
Neither party is liable where performance is prevented or delayed by force majeure under applicable law; if the impediment lasts more than two (2) months, the Terms and current Subscription are automatically terminated.
19 to 25. General clauses
The parties act in good faith and declare their commitments sincere. Headings are for information only. If a clause is held invalid, the others remain in force. These Terms express the entire agreement. Electronic acceptance has the same evidential value as paper. Information collected is treated as confidential, subject to legal exceptions.
26. Language
These Terms were drafted in French. In case of any conflict or differing interpretation, only the French versions prevail.
27. Disputes
These Terms are governed by Swiss law. Disputes are submitted to the competent courts under ordinary law. Consumers may also use the European Commission online dispute resolution platform: http://ec.europa.eu/consumers/odr/.
28 to 29. Pre-contractual information and legal notice
The Member acknowledges having received the essential features and price of the Subscriptions and the Company's identity and contact details before subscribing. The website is published by Global Digital Media SA, share capital CHF 100,000, registered with the Geneva Trade and Companies Register under number RCS B CHE-373.082.366, registered office Case postale 3230, 1211 Genève 3, Switzerland.
